Terms of Service for HausIQ

1. Acceptance of Terms

By accessing or using the HausIQ mobile application, the HausIQ Web Studio, or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is owned and operated by HausIQ (referred to herein as "The Developer", "we", "us", or "our"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

HausIQ is a business-to-business (B2B) software-as-a-service platform designed to assist independent contractors, home inspectors, and property professionals in collecting field data and generating inspection reports. HausIQ is a technology provider, not an inspection agency.

3. User Accounts and Eligibility

You must be at least 18 years old and using the Service for business or professional purposes. You are responsible for maintaining the confidentiality of your login credentials (via Apple or Google SSO) and for all activities that occur under your account.

4. Data and Content Ownership

  • Your Data:You retain all ownership rights to the data, photographs, voice notes, and text you input into the Service ("User Content"). By using the Service, you grant HausIQ a secure, worldwide, non-exclusive license to host, store, and process this data solely for the purpose of providing the Service to you (e.g., syncing across devices and generating your PDF reports).
  • Client Privacy: You are solely responsible for ensuring you have the necessary consent from your own clients and property owners to collect and store their property data using our Service.
  • Report Sharing and Public Links: HausIQ provides unlisted, unique web URLs for the purpose of sharing inspection reports with clients. The User (Inspector) assumes all responsibility for the safe distribution and transmission of these URLs. HausIQ is not liable for unauthorized access, data breaches, or privacy violations resulting from the User or their Client sharing, forwarding, or leaking the provided report URLs.

5. Fees and Services

  • Current Access: HausIQ is currently provided to authorized partners and may include limited free tiers (e.g., promotional report generation). We reserve the right to modify, suspend, or terminate free access at any time.
  • Future Paid Features: We reserve the right to introduce paid features, premium tiers, or usage-based fees in the future. Any transition to paid services or the introduction of third-party payment processing will be communicated to users in advance. You will never be charged without your explicit consent.

6. Acceptable Use

You agree not to use the Service to:

  • Upload unlawful, malicious, or highly sensitive personal data not related to property inspections.
  • Attempt to reverse engineer, hack, or disrupt the offline-first database or cloud synchronization systems.
  • Resell or white-label the software without our explicit written permission.

7. Disclaimer of Warranties (The "As Is" Clause)

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the Service will be entirely uninterrupted, error-free, or completely secure. HausIQ makes no warranties regarding the accuracy, completeness, or legal validity of the PDF reports generated using our tool.

8. Limitation of Liability

To the maximum extent permitted by law, HausIQ and its creator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, lost data, or business interruption, arising out of your use of the Service. You acknowledge that you are solely responsible for the accuracy of your inspections and any disputes with your own clients. In no event shall our total liability to you exceed the amount you paid to HausIQ in the twelve (12) months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, including for violations of these Terms. You may terminate your account at any time using the "Delete Account" feature within the mobile app.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions.
